How is my attorney paid?

Among the questions that come up when considering hiring an attorney, one of the first that comes to mind is “how will I afford this?”

Many attorneys are paid with “contingency fees.” In this case, an agreement exists between the attorney and the client that fees are contingent or dependent upon a certain outcome of the case. In most cases the contingency fee is a percentage of the outcome of the case. In other words, the attorney is paid a portion of the judgment or settlement, if any.

Contingency agreements are a great benefit in a personal injury cases.  For many accident injury victims, paying up front for legal services would make hiring the services of an attorney out of reach. If the case progresses to a trial, these fees can become an insurmountable obstacle to a fair outcome. Typical contingency fees range between 33 ⅓  percent and 50 percent.

At the Law Offices of Houston M. Smith, P.C. your fees will be based on a contingency agreement. Most law firms set their contingency fee between 35 and 50% of the total recovery. In our case, the fee is 33⅓ percent if your case is settled before a lawsuit is filed, and 40 percent thereafter.
